On February 14, 2017, at approximately 1200hrs, the Lower Makefield Township Police Department was summoned to Penn Medicine-Dermatology at 1000 Floral Vale Boulevard for the report of an Invasion of Privacy incident.
Investigating officers spoke to the complainant/victim upon arrival. The victim (a juvenile, 17 years of age), explained that she visits the medical facility about three (3) times per week for treatment of a skin disorder. The treatment involves the victim disrobing to facilitate a light therapy treatment conducted in a light therapy booth (similar to a tanning bed but vertical with the patient standing within).
On February 13th, the victim arrived and began the above described treatment. The treatment was being overseen by a nurse/technician, identified as James Close (44 year old white male). The technician, Close, is situated in the same room but outside the booth where the patient receives the treatment.
The victim stated that during the treatment, she looked down to the floor, and noticed an object by her feet. She recognized the item as a cellular telephone and picked it up. She observed that the cellular telephone was on and appeared to be video recording.
Upon completion of the treatment, the victim said that Close asked to talk her and she denied to speak with him. The victim turned the cellular telephone over to office staff at the facility and told them what had happened.
Investigating officers also spoke with the office manager of the facility in regard to this incident. The office manager related that James Close had come to her following the incident and stated that he had done something wrong. Close further admitted that he had video recorded a patient in a state of undress.
Investigating officers took James Close into custody and transported him to LMTPD for processing and arraignment.
A Criminal Complaint and Affidavit were prepared charging Close with:
Sexual Abuse of a Child (pornography creation), Criminal Use of a Communication Facility, Invasion of Privacy and Endangering the Welfare of a Child.
Close was arraigned by District Justice Burns and remanded to BCP in lieu of $100,000/10%.
A Search Warrant was obtained for the recovered cellular telephone and investigators performed a cursory examination of same. This examination revealed several videos in a deleted file that depict similar incidents as noted above but involving possibly 8 other/different victims.
The cellular telephone has been submitted for further forensic examination.
