RELEASE OF POLICE REPORTS

When residents and visitors of Bensalem Township call police and a report is made, there may be an occasion where an involved party would like a copy of the police report.

The PA Right-to-Know Law has an express presumption that all records in possession of government agencies are public. However, there are more than 30 exemptions to the Right-to Know Law where the police department will not be able to provide a copy of the report as requested.

The Bensalem Township Police Department must also comply with the PA Criminal History Records Information Act (CHRIA) which prohibits the police department from disseminating investigative information including police reports to any persons or entities, other than criminal justice agents and criminal justice agencies in the performance of their duties.

Therefore, the Bensalem Township Police Department, at the direction of the Pennsylvania Office of the Attorney General and the Bucks County District Attorney's Office, does not provide copies of police reports to persons or entities, other than criminal justice agents and criminal justice agencies in the performance of their duties.
